Clippers sale hinges on legalities of family trust

LOS ANGELES (AP) -- The $2 billion sale of the Los Angeles Clippers will hinge on the technicalities of family trust law and whether Donald Sterling's estranged wife had the right to unilaterally negotiate a deal with former Microsoft CEO Steve Ballmer.
The July 7 trial will look at the trust's terms alone and not focus on whether the 80-year-old Sterling is mentally incapacitated, Superior Court Judge Michael Levanas said Monday.
Attorneys will argue about whether Shelly Sterling properly followed the terms of the trust in declaring Donald Sterling to be mentally incapacitated and what happens to a deal that hasn't been closed once a trust is revoked.
Shelly Sterling struck a deal to sell the team to Ballmer in May after Donald Sterling's racist remarks to a girlfriend were publicized and the NBA moved to oust him as an owner.
She had two doctors examine her husband and they declared that he was mentally incapacitated and unable to act as an administrator of The Sterling Family Trust, which owns the Clippers. The terms of the trust say incapacitation can be determined by two licensed doctors without ties to the family who are specialists in their field.
In court filings, Donald Sterling's attorneys argued that he submitted to medical examination under false pretenses, there was undue influence in the doctors' findings, and that the examination and letters regarding his mental capacity were defective and incomplete.
"There was no duping," Shelly Sterling's attorney Pierce O'Donnell said Monday. Donald Sterling voluntarily went to Cedars Sinai Imaging Center to get scans of his brain and there was no requirement to remind Donald Sterling, who is an attorney, or his legal team of the trust's conditions, O'Donnell wrote in court filings.
The judge said another issue likely to be "front and center" during the trial is what happens to a deal that hasn't been closed when a trust is revoked. Donald Sterling revoked the trust on June 9 - weeks after Shelly Sterling negotiated the deal with Ballmer.
Shelly Sterling's attorneys contend that finishing the deal is part of winding down the trust's affairs and that she has an obligation to close the deal or Ballmer will sue.
But Donald Sterling's attorneys argue that a revocation means probate court has no jurisdiction and that winding down affairs refers to passive actions, not a sale that markedly changes the assets in the trust and its value.
Timing has been an issue throughout the proceedings and the judge denied the request by Donald Sterling's attorneys to postpone the trial. An expedited timetable was put forward from the beginning because NBA owners must approve what would be a record breaking deal and are scheduled to meet July 15 to vote.
That's the same day Ballmer's offer is set to expire - and there is no deal without the judge's approval of the sale.
If the sale isn't completed by Sept. 15, the league said it could seize the team and put it up for auction.

Bucks fire Drew, open door to hire Kidd

NEW YORK (AP) -- Jason Kidd had a seat in the coaching box and a jersey in the rafters.
He wanted more. And now his celebrated return to the Nets has turned into yet another ugly exit.
Kidd is set to become Milwaukee's coach after the Bucks and Brooklyn agreed to a deal Monday, a person with knowledge of the details said.
The Bucks then paved the way for Kidd's arrival by firing coach Larry Drew later in the day.
The Nets will receive a second-round draft pick in 2015 that was formerly their own, and another in 2019 belonging to either Milwaukee or Sacramento.

The person spoke to The Associated Press on condition of anonymity because the deal has not been announced.
Kidd went 44-38 in his only season as Nets coach, but then sought control of the basketball operations department and was denied. The Nets gave him permission to talk to other teams about a job.
It was a stunningly quick ending to Kidd's reunion with the franchise he twice led to the NBA Finals as a player. The Nets hired him last June as coach just weeks after he retired as a player and retired his No. 5 before a preseason game in October. Also, he bought a small portion of the team.
There was no reason to believe he wouldn't be back Thursday when he appeared at a press conference where the Nets announced plans for their new practice facility.
But things rarely ended cleanly for Kidd throughout his Hall of Fame-worthy career, and that remains the case as a coach. He was traded from Dallas, his first pro team, when he feuded with teammates. He was shipped out of Phoenix after an arrest for a domestic dispute.
And though he led the Nets to the 2002 and '03 NBA Finals and remained a franchise icon, he soured on the team during the 2007-08 season, and the franchise dealt him back to Dallas.
But as much as the current ownership may have liked him, it wasn't interested in positioning Kidd above general manager Billy King and giving him the power he sought.
Drew went 15-67 in his only season in Milwaukee, but there had been no indication he wouldn't be back before the Kidd situation emerged.
"Despite the challenging season, Larry always handled himself and represented the Bucks in a first-class manner," Bucks general manager John Hammond said in a statement. "Larry did the best he could in a difficult situation, especially given all of our injuries. I want to thank Larry for all of his efforts, and we wish him the best of luck in his future endeavors."
Milwaukee had the NBA's worst record last season and is under new co-owners in Marc Lasry and Wes Edens. Lasry and Kidd are friends.
The Nets could choose from a number of quality coaches who are available, including Lionel Hollins, George Karl and Mark Jackson.
They bypassed experience when they chose Kidd last summer, and the results were ugly early. Kidd removed Lawrence Frank from the bench after lobbying for the Nets to hire his former coach as his lead assistant, and then was fined $50,000 by the NBA after intentionally spilling a drink on the court to delay a game.
The Nets started 10-21 with a high-priced, high-expectations team, though regrouped to reach the second round of the playoffs. Kidd won two Eastern Conference coach of the month honors for engineering a turnaround with a small-ball lineup after center Brook Lopez was lost to a broken foot.
He departs Brooklyn now with free agency opening Tuesday and key Nets Paul Pierce and Shaun Livingston set to hit the market.
Lasry and Edens had said in announcing the purchase of the team in April that they would evaluate the organization. Lasry spoke to a meeting of Milwaukee-area journalists and business leaders on June 23, before the draft, and afterward told The Associated Press that they were still in the evaluation process.
But the new ownership group had given no indication that Drew or Hammond might be in trouble after the franchise's worst season in former U.S. Sen. Herb Kohl's last year as team owner. Hammond spearheaded the NBA draft evaluation process that landed Milwaukee a potential superstar in Duke forward Jabari Parker with the second overall pick.

McCarville had a season-high 22 points and the short-handed Lynx beat the Seattle Storm 74-69 Sunday night.Maya Moore added 14 points for the Lynx (12-5), who have won three of four. NEW YORK -- Liberty coach Bill Laimbeer had a simple message to his team -- start fast.
All season long the New York Liberty has been plagued by slow starts. For one of the rare times this year, the team played a strong first 20 minutes and had just enough to hold on for a victory, beating Connecticut 67-65 Sunday.
"Definitely, we engraved that in our minds," said Cappie Pondexter, who led New York with 14 points. "Coming out of today's game after watching video we saw what we could do better. We came out with a better attitude."
New York (5-11) has struggled in the first half this season, falling behind by an average of seven points in their losses. On Sunday, they played much better in the game's opening 20 minutes. A balanced offense that saw eight different players score and had New York up 34-31 at the break. It was only the fourth time this year that the Liberty have led at the half. They improved to 3-1 in those games. They are 2-10 when they trailed.
Now they just need to work on finishing. New York built an 11-point lead early in the fourth quarter before Connecticut rallied to get within a point in the game's final few minutes.
"We executed a game plan to get a win and we almost shot ourselves in the foot," Laimbeer said. "I wrote on the board after the game two things, `One was we have to play smarter. No question about that. And we have to value two points.' We don't do that very well. Those are two things if we can come to grips with, and understand, and get better at we'll be OK."
Trailing 63-52 early in the fourth quarter, the Sun rallied behind Alex Bentley and Chiney Ogwumike. Bentley scored seven and Ogwumike added four during a 13-3 run that made it 66-65 with 2:21 left. Connecticut had three chances to take the lead after Ogwumike missed a free throw that would have tied it, but couldn't convert any of them.
New York (5-11) couldn't extend the lead and the Sun had one last chance at victory after Anna Cruz missed a 3-pointer from the corner with 31 seconds left.
Katie Douglas' shot from the top of the key bounced off the front of the rim with 6 seconds left and Cruz hit one free throw for the final margin.
"We had the perfect comeback being written and we tore out the last page," said Ogwumike, who had 22 points and a career-best 17 rebounds. "At least we clawed our way back."
Connecticut had won six straight before dropping its last two games.
Pondexter led a spirited New York team that had lost six of its past seven games. The Liberty's star guard, who was scoreless for the first time in her career in a loss on Friday night, was much more aggressive on offense Sunday.
"I knew I had to step up for my team and myself," Pondexter said. "Kind of get going early and not wait and get myself in a rut. I'm happy with my performance, but I know I can do better."
New York led 56-52 early in the fourth quarter before the duo scored seven straight, including a three-point play by Charles and a layup by Pondexter that brought the crowd to its feet and made it 63-52 with 6:52 left.

SAN ANTONIO -- The Washington Mystics needed a win to reaffirm their game plan after four straight losses.
Tierra Ruffin-Pratt had 16 points and Ivory Latta 14 points, helping Washington snap its skid with an 81-70 victory over San Antonio Stars on Tuesday."We're pretty desperate," Washington coach Mike Thibault said. "We lost four in a row, we had played well for most of those games, but just didn't finish. So, today, we finally finished one."Emma Meesseman had 10 points and 13 rebounds and rookie center Stefanie Dolson scored all 10 of her points in the fourth quarter to help Washington (6-9) snap San Antonio's three-game winning streak."It feels great," Dolson said. "Knowing we had a tough road trip, a tough few games, to end it on a good note with a win, playing really well and everyone contributing, it feels really great."After dropping the first three games of a weeklong road trip, including an 89-86 overtime loss in Seattle on Sunday, the Mystics never trailed in the fourth quarter .Kayla McBride scored 17 points, Danielle Robinson added 16 points, Danielle Adams had 12 and Sophia Young-Malcolm 11 for San Antonio (7-7).Washington shot 50 percent from the field, leading by as many as 13 points behind the strong frontcourt tandem of Meesseman and Dolson. After twice making her way into the paint for short jumpers, Dolson sank an 18-foot jumper over Adams in a personal 10-0 run that started at 65-60 and put Washington ahead 73-64 with 4 minutes left.Dolson was questionable after spraining her right knee against Seattle, but played 16 minutes. She was 5 for 7 from the field, helping the Mystics' bench outscore San Antonio's 36-22."Going in at first, I was a little nervous," Dolson said. "I didn't know how I would feel, but then after playing the first half I felt more comfortable in the second half. I give credit to the guards for getting me the ball."San Antonio lost for the fourth time at home this season."We know that we can play better than we did today," Young-Malcolm said. "Our shots weren't really falling."The Stars shot 39 percent from the field, struggling for much of the game despite having open looks. Robinson made her first three shots, but was the only San Antonio player to make a basket in the opening 5 minutes."We didn't make shots, especially from 3," Stars coach Dan Hughes said. "It has been a part of what we do. We had a hard time. I don't know if it was that we didn't get shots. I just don't think that we converted the shots we got."San Antonio, which was shooting 39 percent on 3-pointers, finished 2 for 15 from long range on Tuesday.Washington went on an 11-2 run bridging the first and second quarters, much to the dismay of Hughes. The Mystics were 3 for 3 on free throws in the run, despite Hughes' protests that "they're flopping."McBride's 3-pointer at the halftime buzzer pulled San Antonio within 36-33. She scored the Stars' first six points in the second half to tie the game at 39.Young-Malcolm had three three-point plays in the third quarter, drawing contact in the paint while rising for a short jumper each time.
